1. Agreement to These Terms

These Terms of Service ("Terms") are an agreement between you and NerdHonest LLC, a Georgia limited liability company ("NerdHonest," "we," "our," or "us"). NerdHonest operates Age of Aeternus.

These Terms govern your use of the Age of Aeternus web app, our mobile and desktop apps, our website at aoathegame.com, and the related services we provide (together, the "Service").

When you create an account, you confirm that you accept these Terms and have read our Privacy Policy, and we record that you did. If you don't agree to these Terms, don't use the Service.

Age requirement: you must be at least 18 years old, and have reached the age of majority where you live, to use the Service. When you sign up, you confirm that you are 18 or older, and we record that confirmation.

1.1 Documents That Form Part of These Terms

These Terms include the following documents:

  • our Subscription Terms, which cover paid plans, billing, cancellation and refunds;
  • our Community Guidelines, which cover conduct, reporting, moderation and appeals; and
  • our DMCA Policy, which covers copyright notices and counter-notices.

Our Privacy Policy and Cookie Policy explain how we handle personal data. They describe our practices; they aren't a contract you sign up to.

If documents conflict: the Subscription Terms control for subscription and billing matters. Otherwise, these Terms control over the Community Guidelines and the DMCA Policy. If you use our iOS app, Section 23 explains how Apple's terms fit in.


2. Definitions

  • "Content" means text, graphics, images, audio, character data and other material.
  • "User Content" means Content you create, upload or share through the Service.
  • "Published User Content" means User Content you choose to make public through the Service, for example by publishing homebrew to the public homebrew browser.
  • "Character Data" means character sheets, builds, notes and related TTRPG content.
  • "Party" means a group of users playing together in the Service.
  • "Premium" and "Guide" are our paid plans (see the Subscription Terms). A party's "party Guide" is the party role for the person running the game. The two are different: a party Guide doesn't need the Guide plan, and having the Guide plan doesn't make you a party's Guide.
  • "Loyalty Points" means the points you earn by using the Service, or receive as a no-cash-value bonus with paid memberships or subscriptions. Loyalty Points are never sold.
  • "Virtual Items" means cosmetic items, themes, frames, titles, badges, extra character slots, unlocked modules and other digital items available in the Service.
  • "Codes" means invite, referral, promo, creator and supporter codes (see Section 22).
  • "The List" means a planned public list recognizing founding supporters (see Section 21.9). It isn't shown publicly yet.
  • "Service Assets" means the art, portraits, music, sound effects, interface sounds, fonts and other Content we provide in the Service, including Content we license from third parties.
  • "Third-Party Content" means Content not created by us or by our users.
  • "Session Audio" means the music, ambience and sound effects available in the Service's audio player.

3. Accounts

3.1 Creating an Account

To use most of the Service, you need an account. You agree to:

  • give accurate, current and complete information;
  • keep your password and account secure;
  • keep your information up to date;
  • accept responsibility for everything that happens under your account; and
  • tell us promptly at support@nerdhonest.com if you think someone has accessed your account without permission.

3.2 Account Rules

  • One account per person.
  • Accounts can't be sold or transferred.
  • Don't use someone else's account without their permission.
  • If we have terminated your account, don't create a new one without our permission.
  • We may decline to open an account, for example to prevent fraud or abuse.

Section 19 explains when we may suspend or terminate an account.


4. User Content

4.1 Your Content and the License You Give Us

You keep ownership of the User Content you create.

Service license (all User Content). By uploading, posting, publishing or sharing User Content, you give us a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and publicly display your User Content (together with the name, username and profile information linked to it), as needed to operate, provide, maintain and improve the Service, and to show your User Content to the people you choose to share it with. We use User Content to promote the Service only if it is Published User Content.

This license doesn't give us ownership of your content. It generally ends when you delete the User Content, except to the extent that (a) we must keep it for security or legal compliance, (b) it has been shared with others who still have access to it (see Section 4.2), or (c) it is Published User Content.

Published User Content. If you publish User Content through the public homebrew browser or another public feature, you give us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, modify, adapt, create derivative works from, distribute, publicly perform, publicly display and otherwise exploit that Published User Content for any purpose related to the Service, including:

  • operating and improving the Service;
  • promoting and marketing the Service; and
  • creating, curating and distributing official or featured content, including in paid offerings.

We may edit, format, localize and make other changes to Published User Content, for example for quality, compatibility, moderation or accessibility.

If you delete your account, your Published User Content stays available to other players under this license, credited to "Deleted user." We remove your name, username and photo from it. The item keeps its internal ID, which contains your former account ID. To take a published item down, delete it before you delete your account.

Optional rewards. If we feature or use your Published User Content, we may choose to offer credits, subscription time or other rewards. We don't have to, unless we have a separate written agreement with you.

Moral rights. To the extent the law allows, you waive any moral rights (such as rights of attribution or integrity) in your User Content, and agree not to assert them against us or our users.

4.2 Content You Share with Others

When you share content with your party or friends:

  • they may view, copy and use it within the Service;
  • copies they have saved may stay in their accounts after you delete yours;
  • maps, art and tokens you upload to a party stay with that party after you leave it or delete your account (with your name removed); and
  • you are responsible for what you choose to share.

4.3 Uploads

You may upload images (for example, avatars, portraits, maps and tokens) and, on Premium and Guide, audio. Uploads are subject to the size and file-type limits shown in the app, and to the audio limits in the Subscription Terms. Section 21.4 has extra rules for audio.

4.4 Your Promises About Your Content

When you post User Content, you promise that:

  • you own it or have the right to use and share it;
  • it doesn't infringe anyone else's rights;
  • it follows these Terms, the Community Guidelines and the law; and
  • it doesn't contain malicious code or other harmful material.

4.5 Moderation and Removal

We may remove User Content, disable access to it, or limit its visibility if:

  • it breaks these Terms or the Community Guidelines;
  • it is the subject of a valid legal complaint, such as a DMCA notice;
  • it may expose us or others to legal liability; or
  • we reasonably believe it is harmful to users or to the Service.

Content you publish to everyone may be reviewed before or after it appears. We don't pre-review content shared inside a party, such as homebrew, notes, maps and other items; party members can use it straight away. We act on reports about party content too, and we remove illegal content wherever it is, including in parties. Party members can report content, block other users and leave a party at any time.

People on our team make moderation decisions; we don't use automated tools to decide reports. When we act on your content, we tell you in the app and give the reason. You can appeal any decision within 30 days by emailing support@nerdhonest.com. The Community Guidelines describe how reporting, decisions and appeals work.

4.6 Feedback

If you send us ideas, suggestions or other feedback about the Service ("Feedback"):

  • it isn't confidential;
  • we may use it without restriction and without paying you; and
  • we may develop features or content similar to your Feedback.

5. Loyalty Points and Virtual Items

5.1 How You Get Loyalty Points

  • By using the Service, for example through daily sign-in rewards, chest spins, quests and achievements, and referrals (see Section 22).
  • As a no-cash-value bonus with paid memberships and subscriptions, such as Patreon memberships and App Store or Google Play subscriptions. The Subscription Terms list the current bonuses. Ko-fi tips don't earn Loyalty Points.

Loyalty Points are never sold. You can't buy them on their own, and no payment is a payment for points.

5.2 All Points Are Equal

Points work the same way whatever their source. Any Loyalty Points can be used for anything in the loyalty catalog, including unlocking modules.

5.3 Using Loyalty Points

You can use Loyalty Points on the items in the loyalty catalog, such as themes, frames, titles, extra character slots and early access to content. Every account starts with 5 character slots, and you can't have more than 20 in total. We may change what the catalog offers and what items cost.

5.4 Chest Spins

Chest spins are free and are never sold. You get 3 free spins a day, or 5 while you have Premium or Guide access of your own (access shared through a party, and test purchases, don't count). The count resets at midnight UTC. Each spin awards a random number of Loyalty Points, and the odds are the same for everyone:

  • Common (50% chance): 5 to 15 points
  • Uncommon (30%): 20 to 40 points
  • Rare (15%): 50 to 75 points
  • Epic (4%): 100 to 150 points
  • Legendary (1%): 200 to 300 points

Within a tier, every number of points in its range is equally likely. The app doesn't currently offer bonus spins. If we add them, we will explain here how they are earned, and they will never be sold.

5.5 Loyalty Points Rules

  • Loyalty Points have no cash value. They can't be exchanged for money, and they can't be transferred, sold or traded.
  • Void where prohibited by law.
  • If a payment that came with a points bonus is refunded, you keep the points.
  • We may correct your balance if points are credited by mistake or through fraud or abuse.
  • We may change or end the Loyalty Points program. If we end it, we will give you at least 30 days' notice by email or in the app.
  • We may expire unused points if your account has been inactive for at least 12 months, but only after notifying you in advance by email or in the app. Points that came with an App Store or Google Play purchase don't expire.
  • If we terminate your account for breaking these Terms, you lose your Loyalty Points.
  • When your account is deleted, your Loyalty Points are deleted with it.
  • We aren't responsible for points lost because of technical problems outside our reasonable control.

5.6 Virtual Items Are Licensed, Not Owned

Virtual Items, and anything you unlock with Loyalty Points, a subscription or a Code, are licensed to you, not sold. You get a limited, personal, non-exclusive, non-transferable and revocable license to use them in the Service, under these Terms. You don't own them, and they have no cash value. They may end if your account ends, or if we stop offering the item or the Service, as these Terms describe.

For California residents: if we ever sell you a digital good for money, you are buying a license to use it, not ownership of it, as described above (California Business and Professions Code § 17500.6). Loyalty Points, and items you unlock with points, a subscription or a Code, aren't purchases of digital goods.


6. Prohibited Conduct

You agree not to do any of the following.

6.1 Harmful Behavior

  • Harass, bully or intimidate other users
  • Post hateful, discriminatory or violent content
  • Impersonate others or misrepresent who you are
  • Stalk others or invade their privacy

6.2 Illegal Activity

  • Break any applicable law or regulation
  • Infringe anyone's intellectual property rights
  • Distribute malware or other harmful code
  • Commit fraud or deceive others

6.3 Abuse of the Service

  • Try to gain unauthorized access to the Service or other accounts
  • Interfere with how the Service works
  • Use bots, scrapers or other automated tools without our permission
  • Get around security measures, access controls, usage limits or signed links
  • Reverse engineer or decompile the Service, except where the law allows it despite this restriction
  • Extract, download, record, copy or redistribute Service Assets outside the Service, except as these Terms or the Service expressly allow (for example, offline audio kept inside the app, or streaming and recording your sessions as Section 21.4 allows)

6.4 Commercial and Reward Misuse

  • Use the Service for commercial purposes we haven't authorized
  • Sell, trade or transfer accounts, Loyalty Points, Virtual Items or Codes
  • Use your own referral code, create extra accounts, or use any other trick to collect Codes, rewards, points or trials you aren't entitled to
  • Promote or solicit without our permission

The Community Guidelines give more detail about conduct.


7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original Content (not including User Content) belong to NerdHonest and our licensors. This includes:

  • the Age of Aeternus name, logo and branding;
  • the app design, interface and user experience;
  • the Age of Aeternus game system, mechanics and rules text; and
  • the software and underlying technology.

Except for the rights these Terms give you, we and our licensors keep all rights.

7.2 Trademarks

"Age of Aeternus" and related names and logos are trademarks of NerdHonest LLC. Don't use them without our written permission.

7.3 Third-Party Content and Open-Source Software

  • Some Service Assets are licensed from third parties, such as portraits, interface sounds, music and sound effects. You may use them only inside the Service, as part of using it. Section 21.4 has the rules for Session Audio.
  • Credits and licenses for the open-source software, fonts, art and sounds we use are listed in the app under Account › Privacy Settings › Legal Documents › Open-source licenses. Each track's license is shown in its track details in the music player.
  • Some Content is provided under open licenses, such as CC0 or Creative Commons Attribution (CC BY). Its own license governs that Content. Nothing in these Terms limits what an open license lets you do.
  • The Service may link to third-party websites or content. We don't endorse, and aren't responsible for, third-party content.

7.4 TTRPG Content

Age of Aeternus is an original TTRPG system. Our character-creation tools, game mechanics and related content belong to NerdHonest unless we say otherwise. If you create content based on another game system, you must follow that system's license.


8. Copyright and the DMCA

We respect intellectual property rights and expect our users to do the same. Our DMCA Policy explains:

  • how to report copyright infringement to our designated agent;
  • how to send a counter-notice; and
  • our repeat-infringer policy. Under this policy, an account that receives 3 copyright strikes within 12 months is disabled.

9. Privacy

Our Privacy Policy explains how we collect, use and protect personal data, and our Cookie Policy explains the cookies and similar technologies we use. By using the Service, you acknowledge that you have read them. Where we need your consent for something (for example, analytics or marketing emails), we ask for it separately.


10. Subscriptions and Paid Access

10.1 Plans

Age of Aeternus has a free plan and two paid plans, Premium and Guide. Plan names, prices and features may change, as described in the Subscription Terms.

10.2 How Paid Access Is Offered

  • Patreon: paid access is available through our Patreon founding program. Patreon collects payment under its own terms.
  • App Store and Google Play: where our iOS and Android apps offer it, you can subscribe in the app, and the store bills you.
  • Web and desktop: we don't sell subscriptions directly on the web or desktop, and we don't take card payments ourselves.
  • Codes and grants: see Section 22.

10.3 Renewal, Cancellation and Refunds

  • Renewal. App Store and Google Play subscriptions renew automatically until you cancel. Patreon memberships renew under Patreon's terms.
  • Cancelling. You cancel with the platform that bills you. You keep paid features until the end of the period you paid for.
  • Refunds. Refunds are handled under the policy of the platform that billed you.
  • If we retire a plan, or close your account or end your paid access without cause, we give you at least 30 days' notice, and your paid access continues to the end of the period you have already paid for. Where the billing platform lets us, we cancel the renewal for you. Where it doesn't, we explain how to cancel: App Store subscriptions can only be cancelled by you, in your Apple account settings. Any refund follows the billing platform's policy.
  • If we shut down the Service entirely, we give you at least 30 days' notice and cancel renewals where the billing platform lets us. We refund the unused part of your paid period where the billing platform allows it. For App Store purchases, which only Apple can refund, we help you request a refund from Apple. Lifetime access ends when the Service shuts down. The Subscription Terms (Section 4.4) explain this.

The Subscription Terms explain billing, renewal reminders, cancellation steps and refunds in full.


11. Third-Party Services

The Service works with services run by other companies, including:

  • Google (Firebase and Google Cloud, Sign in with Google, Google Play);
  • Apple (Sign in with Apple, the App Store);
  • RevenueCat, for store purchases;
  • Patreon, for memberships;
  • Ko-fi, for tips (one-time or monthly support payments to NerdHonest LLC, a for-profit company; they aren't charitable donations and aren't tax-deductible);
  • Discord, if you choose to link your Discord account once linking is available; and
  • email delivery providers.

When you use a third-party service, its own terms and privacy policy also apply. We aren't responsible for third-party services, and they aren't responsible for ours. The Privacy Policy lists the companies that process personal data for us.

The Service may also link to external websites. We aren't responsible for their content, privacy practices or availability.


12. Disclaimers

12.1 "As Is"

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE AND NON-INFRINGEMENT;
  • ACCURACY OR RELIABILITY; AND
  • UNINTERRUPTED OR ERROR-FREE OPERATION.

12.2 No Guarantees

We don't guarantee that:

  • the Service will meet your needs;
  • the Service will always be available;
  • results you get from the Service will be accurate; or
  • defects will be fixed.

We don't keep long-term backups of your data. Our file storage keeps deleted files for 7 days before they are permanently removed. Keep your own copies of anything important; you can export your data (see Section 19.5).

12.3 Beta and Experimental Features

Features we label as beta, preview or experimental are provided without warranty and may change or be removed at any time.

12.4 Your Statutory Rights

Some places don't allow certain warranties to be excluded. Where that's the case, these exclusions apply only as far as the law allows. Nothing in these Terms takes away rights you have as a consumer that can't be waived by contract.


13. Limitation of Liability

13.1 Excluded Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERDHONEST AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES;
  • LOSS OF PROFITS, REVENUE, DATA, USE OR GOODWILL;
  • SERVICE INTERRUPTIONS OR LOSS OF DATA;
  • UNAUTHORIZED ACCESS TO YOUR DATA; OR
  • THE CONDUCT OF OTHER USERS OR THIRD PARTIES.

13.2 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID FOR THE SERVICE, DIRECTLY OR THROUGH AN APP STORE OR PATREON, IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM; OR
  • $100 (U.S. DOLLARS).

13.3 What These Limits Don't Cover

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT OR FRAUD, FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR ANY OTHER LIABILITY THAT CAN'T BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

13.4 Essential Purpose

THESE LIMITS APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.


14. Indemnification

You agree to indemnify, defend and hold harmless NerdHonest and its members, managers, employees, agents and affiliates from claims, damages, losses, liabilities and expenses (including reasonable attorneys' fees) brought by a third party and arising from:

  • User Content you upload, share or distribute through the Service, where the claim is that it infringes someone's rights or breaks these Terms or the law;
  • your willful violation of these Terms;
  • your violation of anyone's intellectual property rights; or
  • your fraudulent or illegal conduct.

This doesn't apply to claims arising from:

  • our own negligence, willful misconduct or breach of these Terms;
  • defects in the Service that we knew or should have known about; or
  • any matter for which the law doesn't allow us to be indemnified.

We will promptly tell you in writing about any claim covered by this section. We won't settle a claim without your consent, which you won't unreasonably withhold. We may take over the defense of a claim at our own expense; if we do, you agree to cooperate with us.

EU and UK consumers: this section applies only as far as consumer protection law in your country allows, and won't be enforced where it conflicts with your statutory rights.


15. Dispute Resolution

15.1 Try to Resolve It Informally First

Before either of us files a claim, the one with the complaint will send the other a written description of the dispute and what it wants, and we will both try in good faith to resolve it for at least 30 days.

  • You send your notice to legal@nerdhonest.com.
  • We send ours to the email address on your account.

The time limit in Section 15.5 is paused while this 30-day period runs.

15.2 Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules.

This doesn't take away the protection of any law that can't be waived by contract. If you are a consumer in the European Union or the United Kingdom, you keep the protection of the mandatory laws of the country where you live. If you live in a U.S. state, you keep any consumer rights under that state's law that can't be waived.

15.3 Where Disputes Are Decided

Subject to Sections 15.1 and 15.6, any dispute between you and us arising out of or relating to these Terms or the Service will be decided only by:

  • a state court located in Georgia where venue is proper under Georgia law; or
  • the United States District Court for the Northern District of Georgia, Atlanta Division.

You and we consent to the personal jurisdiction of those courts. If you are a consumer in the European Union or the United Kingdom, you may also bring proceedings in the courts of the country where you live, and we may bring proceedings against you only there.

15.4 Individual Claims Only

TO THE EXTENT PERMITTED BY LAW, YOU AND WE AGREE TO BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION.

If a court decides that this waiver can't be enforced for a particular claim or remedy, then for that claim or remedy only, this waiver is removed and the claim or remedy may proceed in court. This waiver still applies to every other claim.

EU and UK consumers: this section doesn't apply to you. You keep any right you have under the law of your country to take part in collective or representative actions.

15.5 Time Limit for Claims

To the extent permitted by law, any claim arising out of or relating to these Terms or the Service, whether based on contract, tort (including negligence), statute or any other legal theory, must be filed within one (1) year after it arose. Otherwise it is permanently barred.

15.6 Exceptions

Sections 15.1 and 15.3 don't apply to:

  • an individual claim brought in a small claims court that has jurisdiction over it; or
  • a request for a temporary or preliminary injunction to stop the infringement or misuse of intellectual property rights or the misuse of the Service. Such a request may be brought in any court that has jurisdiction.

16. General Terms

16.1 Entire Agreement

These Terms, together with the Subscription Terms, the Community Guidelines and the DMCA Policy (the documents Section 1.1 says form part of these Terms), are the entire agreement between you and us about the Service. They replace any earlier agreements about it. The Privacy Policy and Cookie Policy aren't part of this agreement. Section 1.1 explains which document controls if they conflict.

16.2 Severability

If any part of these Terms is found unenforceable, it will be enforced as far as possible, and the rest of these Terms stays in effect.

16.3 No Waiver

If we don't enforce a right or provision, that doesn't waive it.

16.4 Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example as part of a merger, acquisition or sale of assets. If we do, we will tell you, and your rights under these Terms won't be reduced as a result.

16.5 Notices and Electronic Communications

  • Notices to you: we may send them to the email address on your account, or show them in the app. Keep your email address current.
  • Notices to us: send legal notices to legal@nerdhonest.com, or by mail to our mailing address: NerdHonest LLC, 8735 Dunwoody Place, Suite R, Atlanta, GA 30350, United States. Copyright notices go to our designated agent, as described in the DMCA Policy.

To the extent the law allows, you agree that our electronic agreements, notices and other communications satisfy any legal requirement that they be in writing. Legal process should be served on our registered agent, as listed with the Georgia Secretary of State.

16.6 Force Majeure

We aren't liable for failures or delays caused by events beyond our reasonable control. These include natural disasters, pandemics, war or terrorism, civil unrest, government actions, labor disputes, utility or telecommunications failures, cyberattacks, and failures of third-party providers such as cloud hosting, payment platforms or app stores.

16.7 No Third-Party Beneficiaries

These Terms don't give rights to anyone other than you and us, except as stated in Section 23 (Apple).

16.8 Relationship of the Parties

These Terms don't create any partnership, joint venture, employment or agency relationship between you and us.

16.9 Export Controls and Sanctions

You may use the Service only in compliance with U.S. export control and sanctions laws. You confirm that:

  • you are not located in a country or region subject to a comprehensive U.S. embargo, or designated by the U.S. government as a "terrorist supporting" country; and
  • you are not on any U.S. government list of prohibited or restricted parties.

16.10 Survival

These sections survive the end of these Terms or of your account: 4.1 (including the moral-rights waiver, and the licenses for Published User Content and for Content shared with others), 4.4, 4.6, 5.5 (the loss of points on termination), 5.6, 7, 12, 13, 14, 15, 16, 19.3, the third-party audio disclaimer in 21.4, the streaming permission in 21.4 for streams and recordings you published while it applied (subject to its withdrawal rule), and 23.1.

16.11 Interpretation

"Including" and "for example" mean "including without limitation." Headings are for convenience only and have no legal effect.

16.12 Language

These Terms are written in English. If we provide a translation and it conflicts with the English version, the English version controls, unless the law requires otherwise.


17. Changes to These Terms

We may change these Terms. Changes apply going forward only. They don't apply to a dispute that arose before the change took effect.

  • Material changes. We will tell you in advance by email and in the app, and summarize what changed. When you next open the app while signed in, we will ask you to review and accept the updated Terms before you continue. We record your acceptance and the version you accepted.
  • Minor changes. For changes that don't materially affect your rights (for example, clarifications or contact details), we will post the updated Terms with a new "Last Updated" date.

If you don't agree to a change, stop using the Service. You can delete your account at any time (Section 19.4). Ending your account, or declining updated Terms, doesn't cancel a store subscription or Patreon membership. Cancel it with the platform (Subscription Terms Section 4.1).

If you used the Service before this version of these Terms took effect, this version applies to you from when you accept it in the app. Until then, the version you last accepted continues to apply.

This section also applies to changes to the Subscription Terms, the Community Guidelines and the DMCA Policy, with these differences:

  • Subscription Terms: Section 9 of the Subscription Terms explains when the app asks you to agree to a change.
  • Community Guidelines and DMCA Policy: we tell you about material changes in advance by email, but the app doesn't ask you to accept them. They apply from the date stated in the notice.

18. Changes to the Service

We may change, add or remove features, set usage limits, or restrict access for maintenance or updates. We will try to give advance notice of changes that significantly affect you. A change that materially reduces what a paid plan includes applies to you only from your next renewal, except where it is needed for security or to comply with the law (Subscription Terms Section 7.3).

If we decide to shut down the Service entirely, we will give you at least 30 days' notice, so that you can export your data. We will cancel renewals where the billing platform lets us, and explain how to cancel where it doesn't (App Store subscriptions can only be cancelled by you). We will refund the unused part of any paid period where the billing platform allows it; for App Store purchases, we will help you request a refund from Apple. Lifetime access ends when the Service shuts down. Section 4.4 of the Subscription Terms explains the details.


19. Suspension, Termination and Deletion

19.1 By You

You can stop using the Service and delete your account at any time (see Section 19.4). Deleting your account doesn't cancel a subscription with the App Store, Google Play or Patreon; cancel it there.

19.2 By Us

For cause. We may suspend or terminate (permanently disable) your account, or restrict features, if:

  • you break these Terms or the Community Guidelines;
  • you take part in fraud, including payment fraud or reward abuse, or other illegal activity;
  • you harass, threaten or endanger other users;
  • you are a repeat copyright infringer under our DMCA Policy;
  • you put the security of the Service or other users at risk;
  • you create accounts to get around a ban or restriction; or
  • the law requires us to.

Where we can, we will tell you the reason. We won't if the law prevents it, or if telling you would put someone at risk or undermine an investigation. You can appeal as described in the Community Guidelines. For a serious violation, we may act immediately and without prior notice.

Without cause. We may also close an account, or end your paid access, for another reason, but only with at least 30 days' notice, and never before the end of the period you have already paid for. Where the billing platform lets us, we will cancel the renewal for you. Where it doesn't, we will explain how to cancel: App Store subscriptions can only be cancelled by you, in your Apple account settings. Any refund follows the billing platform's policy, as described in Section 4.4 of the Subscription Terms.

Inactivity. We may close an account that has been inactive for 24 months or more. Before we do, we will notify you in advance by email or in the app and give you a chance to keep it.

19.3 What Happens on Termination

When your account ends:

  • your right to use the Service ends;
  • we delete your data as described in our Privacy Policy, except what we must or may keep as described there;
  • if we terminate your account for breaking these Terms, you lose your Loyalty Points and Virtual Items, without refund except where the law requires one; and
  • the sections listed in Section 16.10 continue to apply.

Ending your account, or declining updated Terms, doesn't cancel a store subscription or Patreon membership. Cancel it with the platform (Subscription Terms Section 4.1).

19.4 Deleting Your Account

How to delete:

  • In the app, open Account › Privacy Settings (also reachable from Profile Settings › Privacy, Data & Legal), then Your Data › Danger Zone › Delete Account; or
  • email privacy@nerdhonest.com from your account email address.

30-day grace period. After you ask to delete your account:

  • your public profile is hidden at once;
  • you are signed out on every device (another device can stay signed in for up to about an hour);
  • you can sign back in and use the Service during the 30 days; and
  • you can cancel with Cancel Deletion Request. Signing in alone doesn't cancel it.

After the 30 days, your account is permanently deleted, usually within about a day. It can take longer if many deletions are due at once.

What happens to your content:

  • Your account, characters, private and party homebrew, personal uploads, private notes and drafts are deleted.
  • Your published homebrew stays, credited to "Deleted user" (see Section 4.1).
  • Maps, art and tokens you uploaded to a party stay with the party, with your name removed.
  • Parties you own pass to another member: the party's Guide first, then an admin, then any other member. A party with no other members is deleted.

The Privacy Policy (Section 6) lists exactly what is deleted, what we keep and why, and the current limits of deletion.

19.5 Exporting Your Data

You can get a copy of your data in a machine-readable format (JSON):

  • In the app, open Account › Privacy Settings › Your Data › Export My Data; or
  • email privacy@nerdhonest.com.

The export is prepared in the background. We email you a download link, which works for 7 days. You can request one export every 7 days. The Privacy Policy (Section 6.2) lists what the export contains.

21. Additional Terms for Specific Features

21.1 Parties

  • A party's owner, admins and party Guide have control over the party, as shown in the app.
  • Party members can see what other members share with the party.
  • If you leave a party, you may lose access to content shared there. Maps, art and tokens you uploaded stay with the party.
  • When any member of a party has active Guide access, the party shares Guide party audio and some other Guide features, but not the subscriber's personal limits, such as the larger offline cache. When any member has active Premium or Guide access, modules that party members imported or created (not official Age of Aeternus content) can be shared with the party. Section 8 of the Subscription Terms has the details.
  • Party content must follow these Terms and the Community Guidelines.

21.2 Characters

  • You keep ownership of your original character concepts.
  • Characters you create with our tools are covered by the license in Section 4.1.
  • Character Data is stored on our servers. We don't keep long-term backups, so a character you delete can't be recovered.

21.3 Social Features, Profiles and Whispers

  • Your profile is private by default. It appears in Discover and community search only if you turn on Appear in community directory in Profile Settings. Once it's on, anyone using the Service can see your public profile, including people who aren't signed in.
  • People who know your exact username can send you friend requests and party invites, even if your profile is private.
  • Blocking someone removes your friend connection and any pending friend requests between you, and stops new friend requests, party invites and whispers between you. It doesn't remove either of you from parties you already share.
  • Whispers are private messages on the virtual tabletop between members of the same party. One side of each whisper must be the person in the party's Guide role, the party owner or a party admin (having the Guide plan doesn't count). A whisper can't be edited once sent. The sender can delete it, and so can the party's owner or an admin. Otherwise it stays with the party.
  • Social features must be used in line with the Community Guidelines.

21.4 Session Audio

Same library for everyone. The Session Audio library is the same on every plan. Paid plans add features and higher limits (see the Subscription Terms). We don't guarantee any particular audio quality.

Playing audio. You may play Session Audio in the Service as part of your sessions. Offline audio is stored inside the app for playback there only.

Streaming and recording your sessions. You may stream or record your sessions (for example, on Twitch, YouTube or a podcast) with Session Audio from our library audible as it plays in the Service, including through a stream overlay (Section 21.7). This permission covers every track in our library, subject to these conditions:

  • Credit for CC BY tracks. Each track's license is shown in its track details in the music player. For a track whose license is shown as CC BY 4.0, you must credit it in your stream or video description, using the credit line in the track details (title, artist and license).
  • Withdrawal for specific tracks. We may withdraw this permission for specific tracks, for example if a licensor objects. We will give notice in the app or by email. After that notice, don't use the withdrawn tracks in new streams or recordings. Content you published before the notice isn't a breach of these Terms, but the rights holder may still act on it, for example by claiming or muting it.
  • What this permission doesn't cover. You may not extract, isolate, sample, remix or redistribute tracks apart from your session, or present them as your own work. It covers our library only, not audio uploaded by you or other users; whoever uploads audio is responsible for having the rights to it.
  • Automated claims. Rights holders may register music with content-identification systems such as YouTube Content ID. We can't prevent automated claims against your stream or video.

Open-license tracks. Tracks shown as CC0 or CC BY 4.0 are also available under those licenses, and their licenses govern them. Nothing in these Terms limits what those licenses let you do.

Other rules for Session Audio. Apart from the streaming permission above, you may not:

  • extract, export, download outside the app, redistribute, sell, sublicense or use Session Audio on its own;
  • get around, disable or interfere with any content protection or access control;
  • use automated tools to access, download or capture Session Audio; or
  • present Session Audio as your own work.

Third-party licensed audio. WE GIVE THE PERMISSIONS IN THIS SECTION ONLY TO THE EXTENT OF THE RIGHTS WE HOLD. THIRD-PARTY LICENSED AUDIO IN THE SERVICE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR CLAIMS, TAKEDOWNS, STRIKES, MUTING OR LOST REVENUE ARISING FROM YOUR STREAMS OR RECORDINGS, OR FROM YOUR USE OF SESSION AUDIO OUTSIDE WHAT THESE TERMS PERMIT. This paragraph is subject to Sections 12.4 and 13.3.

Audio you upload. When you upload audio (Premium and Guide):

  • you promise that you own it or have the legal right to use and share it;
  • don't upload music from commercial streaming services (such as Spotify, Apple Music or YouTube Music) or other music you don't have the rights to;
  • uploaded audio is subject to our DMCA Policy and may be removed after a valid copyright complaint;
  • repeated copyright violations may lead to the loss of upload privileges or termination of your account; and
  • you keep ownership of your uploaded audio. We use it only as needed to provide the Service to you.

21.5 Profile Songs

You can choose a track from the Session Audio library as your profile song. If your profile is visible, signed-in visitors hear it play automatically unless they have turned off Autoplay profile songs in Profile Settings. Playing someone else's profile song counts toward your daily download allowance, unless the track is already cached or you have Guide access. Credit lines are shown where a track's license requires them.

21.6 Virtual Tabletop

You may upload maps, tokens and other assets to the virtual tabletop, within the limits shown in the app. Party drawings, fog of war, tokens and whispers belong to the party's game. They stay with the party, and some of them keep a reference to your account even after you delete it (see the Privacy Policy, Section 6.1).

21.7 Stream Overlays and Stream Deck (Guide)

  • Stream overlays. If you create a stream overlay link, anyone who has the link can see the overlay's character information (display name, level, current and maximum HP, state and conditions). If you turn on music for the overlay, they can also hear your party's music as it plays. Treat the link like a password. Links expire, and you can revoke them. Music played through an overlay is covered by the streaming permission in Section 21.4. If you turn on dice, people with the link can also see your party's dice rolls, including roll notes and rolls the overlay doesn't display.
  • Stream Deck control connects to the app on your own computer only.

21.8 Linked NerdHonest Apps

You can link your account to Writerer, another NerdHonest app. Linking shares only your Age of Aeternus account ID (a pseudonymous identifier) and your subscription tier, in both directions. Linking gives no bonuses at the moment. After you unlink, you must wait 24 hours before you can link again. The Privacy Policy (Section 2.3a) has the details.

21.9 Public Recognition

The List isn't shown publicly yet. If we launch it, being listed will be opt-in: you will choose the display name or alias, and you will be able to hide or remove your entry at any time.


22. Codes and Grants

We offer several kinds of Codes and grants:

  • Invite codes, which let someone join the Service. We give them only to people who pay for access (through Patreon, or an App Store or Google Play subscription), people with lifetime access, and admins. Each invite code we issue can be used once. Unused codes may be deactivated if their holder no longer qualifies.
  • Referral codes, which may earn Loyalty Points for the referrer while the referral program is running: when a new user signs up with the code, and once more when that user starts paying, either when their store subscription becomes paid (a free trial counts only once it converts) or when their first Patreon payment settles. You can't use your own referral code, and each account can be credited to only one referrer.
  • Promo and creator codes, which may give Loyalty Points, an invite, or Premium or Guide access for a set period or for life. Creator codes are promo codes shared by our creator partners. Creators may receive rewards or other benefits from us. When they promote Age of Aeternus or a code, they must clearly disclose that relationship.
  • Supporter codes, which give supporter recognition, such as a supporter label and cosmetics. They don't give paid access.
  • Grants of paid access or other benefits that we give directly.

Rules for all Codes and grants:

  • Each Code can be redeemed once per account, unless the Code says otherwise. You can redeem only one supporter code per account.
  • Codes and grants have no cash value. They can't be exchanged for money, sold or transferred.
  • Codes may expire, and the rewards they give may be limited to a period.
  • Access periods from separate Codes may add together.
  • Void where prohibited by law.
  • No self-referral, fake accounts or other fraud. We may cancel Codes, rewards and access obtained through fraud or abuse, or in breach of these Terms.
  • We may change or end any Code program. Doing so won't take away rewards you have already received fairly, including lifetime access already granted.

"Lifetime" access lasts for as long as we operate Age of Aeternus. If we retire or rename the plan it was granted for, we move you to the closest plan we still offer, at no cost. Lifetime access ends only if we shut down the Service (after at least 30 days' notice) or if your account is terminated for breaking these Terms. It can't be transferred.


23. App Store and Google Play

23.1 Apple App Store

If you downloaded our app from Apple's App Store, this section applies in addition to the rest of these Terms.

  • Agreement with us only. These Terms are between you and NerdHonest, not Apple. NerdHonest, not Apple, is solely responsible for the app and its content.
  • License to use the app. Your license to use our iOS app is governed by Apple's Licensed Application End User License Agreement (the "Standard EULA"), together with these Terms. You may use the app only on Apple-branded products that you own or control, as the App Store's Usage Rules permit. If the Standard EULA and these Terms conflict about the license to use the app, the Standard EULA controls.
  • Maintenance and support. NerdHonest, not Apple, is solely responsible for maintaining and supporting the app. Apple has no obligation to provide any maintenance or support for it.
  • Warranty. If the app fails to conform to any warranty that applies and that isn't effectively disclaimed, you may notify Apple, and Apple will refund the purchase price (if any) you paid for the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are NerdHonest's responsibility, to the extent they aren't disclaimed in these Terms.
  • Product claims. NerdHonest, not Apple, is responsible for addressing any claims by you or a third party about the app or your use of it. This includes product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • Intellectual property claims. If a third party claims that the app, or your possession and use of it, infringes their intellectual property rights, NerdHonest, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • Developer contact. Send questions, complaints or claims about the app to NerdHonest LLC, 8735 Dunwoody Place, Suite R, Atlanta, GA 30350, United States, or support@nerdhonest.com.
  • Third-party terms. When you use the app, you must comply with any third-party agreements that apply, such as your mobile data plan.
  • Apple as a third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license to use the iOS app. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

23.2 Google Play

If you downloaded our app from Google Play, Google Play's terms also apply to your download and to purchases made through Google Play. Google isn't responsible for the Service.


Document History

  • Version 2.0 (October 2, 2026). NerdHonest LLC (Georgia) is named as the company you contract with. Georgia law now governs these Terms. Disputes go to a Georgia state court or the federal court in Atlanta, with a mutual 30-day informal step and a small-claims option. EU, UK and U.S. state consumer protections are kept, and there is no jury-trial waiver. Loyalty Points are live: they can be earned, or given as a no-cash-value bonus with payments, but never sold. You keep points after a refund. Added Codes and Grants, and defined "lifetime". Described account deletion: published homebrew stays, credited to "Deleted user"; party ownership passes to another member. Corrected the data export description. You may stream and record your sessions with library music audible (CC BY tracks need a credit); we may withdraw this for specific tracks if a licensor objects.
